the case upholding the constitutionality of limitations on removal of agency principals was Humphrey's Executor and honestly it wasn't a masterpiece of constituitonal reasoning. In 1935, FDR and the Supreme Court were at war and the case was probably mud in FDR's eye.

That said, a whole edifice got built on it. There are at least a dozen what used to be "independent" agencies -- the FTC, the NLRB, the EEOC, the SEC, etc. -- that had members appointed on a staggered basis and only removable for cause. So, an incoming Democratic president might be looking at an NLRB with a majority GOP board members and nothing he could do about it right away.

The idea is that the agencies were supposed to be "expert" and relatively insulated from political pressure. Empirically, it's not clear that was true.

So a President can remove every member of the NLRB, SEC, etc. that he doesn't like.

I'd say this will put a lot of pressure on the confirmation process. They still need to be confirmed by the Senate and the filibuster is in place. Winning the Senate, always a priority, is really a priority now.

I co-authored an amicus brief on Cook's side. The Supreme Court's differential treatment of the Fed is disingenuous, but pragmatically necessary to keep monetary policy away from the president.

Interesting that the Cook decision went the other way and the late-arrive ballots decision was decided the way it was and written by Coney Barrett. The analysis of which I'll leave to omaha; just reporting that the decisions today are definitely split.

must be prepared on Day 1, to make wholesale changes to the leadership of all these organizations that have and will be corrupted by the current administration. Additionally, they must work with Congress to enact sweeping changes to the current regulations to minimize / prevent Presidential overreach and corruption in the future.

Was making government too complex for the typical person to have time to bother understanding.

I think the majority - not a vast one, but a real one - just actually think the POTUS can do whatever he wants to do. So then when you start talking about or even behave like an opposition party, that majority thinks you're the ones going against "the way the system works."

come January 2029. That will be dependent on big wins this fall and at least some material wins in November 2028.

Regarding Constitutional changes, the only likely progress would be dependent on a sizable change in Supreme Court membership after Dem wins this November, and more importantly filling any open seats or increase of numbers come January 2029.
